NEC Baby Formula Lawsuit

Parents of premature babies are filing lawsuits against the manufacturers of Similac and Enfamil baby formula, after their newborns consumed cow’s milk-based formula. The consumption of these products has been linked to the development of NEC, or necrotizing enterocolitis, among premature babies.

What is Necrotizing Enterocolitis (NEC)?

Necrotizing Enterocolitis is a rare gastrointestinal disease that most typically occurs in premature infants. This disease causes the tissue lining of the intestine to become inflamed, die, and to slough off.

Premature babies may be at risk of contracting NEC while still in the hospital. While in the neonatal intensive care unit, some babies are fed certain Similac and Enfamil formulas, which are causing higher rates of NEC.

Lawsuits are being filed against Mead Johnson and Abbott, the manufacturers of these products, for failure to warn of customers of the risks associated with their product.

Signs and Symptoms of NEC

A premature baby with necrotizing enterocolitis may have any of the following symptoms:

  • a swollen or tender belly
  • red, blue, or gray discoloration of the belly
  • trouble feeding
  • food staying in the stomach longer than expected
  • constipation
  • diarrhea
  • being lethargic or less active
  • a low or unstable body temperature
  • green vomit (containing bile)
  • apnea (pauses in breathing)
  • bradycardia (slowed heart rate)
  • hypotension (low blood pressure)
