Exactech Recall Legal Update

A schedule for the first jury trials against Exactech will be discussed in federal court later this month as part of the growing litigation over the company’s failed medical devices. You can view the court’s case management order here. The first case to reach trial in New York federal court will take at least another year of litigation, as the current schedule calls for depositions and other work to take place between now and December 2024. Final pretrial motions will be filed no later than February 2025.

Exactech recall details

The global medical device company known as Exactech faces nearly 400 lawsuits in federal court, and dozens more in Florida state court, related to its “urgent medical device correction” notice. Thousands of plastic pieces used in a variety of Exactech products—namely hip, knee, and ankle devices—have been recalled due to manufacturing and other problems, and now countless consumers are suing for personal injury because their devices must be surgically revised.
