Women with ovarian cancer continue to file lawsuits against Johnson & Johnson, the maker of talcum powder, with more than 47,000 lawsuits now pending in federal court.
Earlier this year Johnson & Johnson made an offer of $8.9 billion to settle certain claims by women diagnosed with ovarian cancer after using talc for genital hygiene. The lawyers at Alex Davis Law Office represent women from all over the country in the litigation. Most federal cases are pending in New Jersey as part of a consolidated proceeding created in 2016 called MDL 2738. The J&J offer, detailed in this New York Times story, is problematic for several reasons. First, it required court approval as part of a J&J bankruptcy tactic, even through the company has plenty of money. Second, the offer would cover all past, present and future talcum powder claims.
Talcum power lawsuits keep growing
There are at least 70,000 cases and claims already, including the above number in federal court combined with other cases in state court and still more people who have not yet filed lawsuits. Talcum powder cancer lawsuits are currently among the largest mass tort litigations in the country, behind 3M military ear plugs and Camp Lejeune toxic water claims. A list of the largest mass tort cases is maintained by the Judicial Panel on Multidistrict Litigation.
The talcum powder attorneys at Alex Davis Law Office believe that companies should not be allowed to hide behind the veil of bankruptcy court as part of a legal strategy to avoid responsibility for their harmful products. This would set a dangerous precedent.
Although talcum-based baby powder is no longer for sale in the United States under the J&J brand name, it is still linked to ovarian cancer and asbestos, a fact J&J knew about for decades as thousands of women used it on a daily basis.
