The first trials involving Exactech’s recalled hip and knee devices are scheduled for late 2024 and early 2025, and the number of lawsuits over the failed devices now exceeds 1,000 for the first time.
Injured patients all over the country are undergoing costly and painful revision surgeries to have the company’s defective plastic components removed from their bodies due to premature deterioration. There are now 882 individual lawsuits over the recalled Exactech devices pending in New York federal court, with additional cases in Florida state court where the company is based.

The first four trials in Florida will take place between October 2024 and January 2025. They will involve hip components only. The first trials in New York federal court will be drawn from a pool of 24 plaintiffs with failed knee devices. In the meantime, lawyers for both plaintiffs and defendants are taking depositions of key witnesses and reviewing hundreds of thousands of pages of documents related to the recall and the defective plastic components.
