Hundreds of lawsuits against Indivior, the manufacturer of Suboxone film strips, continue to move forward in federal court with the first jury trials possible in early 2028.
The Suboxone cases are part of a consolidated proceeding called Multi District Litigation (MDL 3092) in front of Judge Philip Calabrese.
Suboxone trials update
Fifty lawsuits for dental injuries caused by Suboxone film strips have been chosen at random to be worked up and scheduled for bellwether trials. Bellwether trials are used to identify how juries may respond to various arguments, from both Plaintiffs and Defendants, and can influence future settlement negotiations and litigation strategy.
Based off the most recent scheduling order from the Court, we expect the selection of the first bellwether cases to happen in early 2027. It is important to note, however, that these dates are subject to change based on future court orders.
Settlement update
Suboxone strips are placed under the tongue and are used to treat opioid use disorder. The strips contain a combination of buprenorphine and naloxone to reduce cravings and manage withdrawal. While no settlements for dental injuries related to Suboxone film strips have occurred yet, there have been settlements in the past including $1.4 billion for deceptively marketing the drug as safer than alternatives, $600 million for taking part in illegal practices to increase prescriptions, $60 million in an antitrust settlement, and $285 million for allegedly suppressing competition by a generic Suboxone brand.
