Spinal stimulator lawsuits consolidated in federal court

A batch of lawsuits targeting spinal stimulator devices made by Boston Scientific is heading to federal court in Los Angeles after a panel of judges decided the cases are similar enough to be litigated together ahead of trial.

The new cases are now part of MDL 3181, In Re: Boston Scientific Corporation Spinal Cord Stimulator Products Liability Litigation, before Judge Josephine Staton in the Central District of California. MDL stands for Multi District Litigation, a procedural tool where individual lawsuits are brought before a single judge for the sake of efficiency and consistency. Hundreds of lawsuits over the spinal cord stimulators are expected to be filed eventually.

Early stimulator cases filed by our legal team

Alex Davis Law Office filed one of the earliest cases against Boston Scientific for its stimulator devices, which can deliver unexpected and painful shocks to patients if they are not programmed correctly or if they malfunction. Boston Scientific makes a variety of devices, including the WaveWriter Alpha Spinal Cord Stimulator System. Our legal team is also pursuing injury cases against Abbott Laboratories, Nevro and Medtronic for similar products. Those cases are not part of the Los Angeles proceeding, but there is an effort underway to change that.

First court date set for August 2026

Judge Staton will hold an initial hearing in Los Angeles to discuss the Boston Scientific cases on August 5, 2026. Ahead of that hearing, Judge Staton asked lawyers for both the plaintiffs and defendants to submit a joint report of up to 25 pages detailing key issues and facts in the stimulator cases.
